TRADING TERMS & CONDITIONS
Orders to Knot Gardens Unravelled
are accepted subject to these Terms & Conditions. These do not supercede
statutory rights under the UK Sale of Goods acts.
We aim always to be Fair, Reasonable
and Honest, and expect our customers to be the same. We trade on
the basis: “If you like what we do, please tell your friends: if
you don't, then please tell us!"
Condition of supply:
Knot Gardens Unravelled designs and plans are supplied only for
personal use by the customer in his/her own garden and are not
transferable and may not be copied in any way or used in any form
of trade whatsoever, including garden and landscape design and construction
services except with the express permission of Knot Gardens Unravelled.
Copyright: All
material supplied by Knot Gardens Unravelled, including, plans,
designs, illustrations, photographs, order forms, leaflets, websites,
emails, and any other material is copyright © Knot Gardens Unravelled
and may not be copied, reproduced or transmitted in any form whatsoever.
Payment & Currency:
Payment is accepted by post with cheque drawn on a personal bank
account in any currency (contact us first for current exchange rate),
UK postal order, UK£ or US$ cash, or on-line from a Paypal
account or by credit or debit card with secure credit card processing
by PayPal. No orders can be despatched until payment has cleared.
Duties & Local Taxes:
Our quoted prices include Value Added Tax at the current rate where
applicable. Non EU customers are responsible for any duties and/or
taxes levied at the point of entry into the destination country.
A commercial invoice is provided with all goods shipped.
Shipping/Carriage:
The prices quoted on our order form are the prices of the goods
including delivery to the stated destination. These charges include
carriage for UK orders by Royal Mail first class recorded delivery
post and for overseas orders by Royal Mail Airmail which require
a signature on delivery.
Ownership of goods:
Ownership of goods passes to the customer when goods are despatched
from our premises.
Loss or Damage in
Transit: We are not responsible for any loss or damage which
occurs after goods leave our premises in the hands of postal services
etc. If you do receive damaged goods, inform us and your postal
service and retain all relevant documentation as you will need to
make a claim against the postal service in your country. If you
receive a battered parcel, if delivered by a service requiring a
signature on delivery, note the fact on the delivery note, even
before you open the package to examine the contents. If you are
unable to open the damaged package in the presence of the delivery
person, make sure that you sign for it as Damaged package;
goods not yet inspected or similar to warn the postal service
that a claim may be forthcoming. We cannot replace goods damaged
in transit without further payment.
Quality of Goods/Fitness
for Purpose: The goods we supply are suitable for the purposes
described on our website and in our literature, provided that the
goods are used in accordance with any instructions supplied and
in accordance with good and normal practice. They are covered by
UK Consumer Protection legislation.
Returns and Refunds:
Because of the nature of the goods supplied, we cannot accept returns
or provide refunds. However, if there are any problems with the
goods, please inform us and we will make every effort to ensure
you are satisfied with the service we provide.
Despatch: All
Knot Gardens Unravelled plans are individually prepared for each
customer and personalised with the customer’s name. We therefore
do not hold stocks of plans. We endeavour to despatch goods within
one week of receipt of orders, but the interval may be longer if
public holidays or holiday periods intervene. Therefore, please
allow up to 28 days for delivery. If your order is required urgently
or by a specific date (e.g. as a present) let us know and we will
do our best meet your requirements, although we cannot guarantee
delivery dates.
Confidentiality:
We undertake to exercise all reasonable precautions to keep information
supplied to us by customers strictly confidential. We do not supply
mailing or contact information to third parties.
Applicable Law and
Courts of Jurisdiction: All transactions are governed by English
Law and any legal actions arising out of such transactions shall
be subject to the English legal processes and under the jurisdiction
of English Courts.
